Q: Our school system says our child doesn't qualify for special services because they think it is a behavior problem, not a learning disability.

Answer:

The post above.. IEPs are Covered under FEDERAL Laws.. applies to your situation as well. Plus, Under IDEA --If it is a "behavior" problem.. Your school MUST put in place a Behavior Intervention Plan with POSITIVE support and direction. Additionally, they MUST do a comprehensive evaluation to insure your child does NOT have a learning disability.. Have they done that? You can always have your child privately tested if they don't or won't. You can also tell them you want them to pay for an independent evaluation (as they are required to do under IDEA -Federal Law- if you do not agree with their evaluation). I would highly recommend becoming knowledgeable about your child's rights as school systems will walk all over parents who don't KNOW their child's rights!!
